Conn. Supreme Court Rules in Sex Shop Legality

HARTFORD, Conn. (AP)  -- The Connecticut Supreme Court said that the town of Berlin can restrict sexually oriented business from opening near a residential neighborhood in a decision with statewide implications.

The high court made its ruling Monday, a month after hearing arguments from attorneys representing the town and VIP, an adult novelty store. The dispute is over the legality of a Berlin ordinance regulating the location of sexually oriented businesses.

Town officials contend the ordinance is a way to control the adult business that have popped up in recent years. The ordinance bars adult-themed businesses from being within 250 feet of a residentially zoned area.

The VIP ran into town opposition when it wanted to turn a former furniture store into an adult business.

Lawyers for the company have argued the town is wrong to impose an ordinance that would usurp municipal zoning.
