32-Year-Old Man Struck, Killed on Montauk Highway

NEW YORK (1010 WINS) -- Police say a 32-year-old Shirley man was killed in a tragic accident on the Montauk Highway Sunday night.
Investigators originally believed Elmer Mendez Gonzalez was the victim of a fatal hit-and-run. However, the 19-year-old driver of the 1999 Toyota SUV which struck Gonzalez had called 911 around 10 p.m. Sunday to report that he had hit something with his vehicle, police say.
Officers responded to the scene and told Kevin Daly that he had possibly struck a deer.
A search of the immediate area was conducted with no results and an accident report was filed for a vehicle striking an unknown object, police say.
Gonzalez' body was found off the road on Montauk Highway and Smith Road early Monday west of the location Daly had pointed out previously. Officers determined that the two incidents were connected and that Daly had mistakenly given the wrong location of the accident to responding officers Sunday night.
Police say no charges will be filed against Daly.
