Accused DWI Cop Pleads Not Guilty in Fatal B'klyn Crash

NEW YORK (AP/1010 WINS)  -- An off-duty New York City police officer accused of driving drunk and fatally striking a pastor's daughter as she attempted to hail a cab on a Brooklyn street pleaded not guilty Thursday at his arraignment hearing.

Carol D'Auria reports

Andrew Kelly was arraigned Thursday in state Supreme Court in Brooklyn on charges including vehicular manslaughter and driving while intoxicated. He plead not guilty and remains free on bond.

Prosecutors say Kelly hit Vionique Valnord with his SUV on Sept. 26 as she tried to hail a cab after a wedding reception.

Lawyer Arthur Aidala said a blood-alcohol test showed Kelly had no alcohol in his system. The test was administered seven hours after the incident. There are allegations that other cops covered up for Kelly and delayed his BAC test.

Authorities say officers at the scene smelled alcohol on Kelly's breath, but he refused to take a breath test.

Kelly and two other officers have been suspended in the incident.
